Article 3 - Applicability
These general terms and conditions apply to any offer made by the entrepreneur and any distance agreement and orders made between the entrepreneur and consumer. Before the distance agreement is concluded, the text of these general terms and conditions must be made available to the consumer. If this is not reasonably possible, before the distance agreement is concluded, it will be stated that the general terms and conditions can be viewed with the entrepreneur and will be sent free of charge upon request. If the agreement is concluded electronically, in deviation from the previous sentence, the text of these general terms and conditions may be made available electronically to the consumer in a way that allows easy storage on a durable data carrier.
Article 4 - The Offer
The offer contains a full and accurate description of the offered products and/or services. Obvious mistakes or errors in the offer do not bind the entrepreneur. All images, specifications, and data in the offer are indicative and cannot be grounds for compensation or dissolution of the agreement. Images of products are a truthful representation of the offered products. The entrepreneur cannot guarantee that the displayed colors exactly match the actual colors of the products.
Article 5 - The Agreement
The agreement is concluded, subject to the provisions of paragraph 4, at the moment the consumer accepts the offer and meets the associated conditions. If the consumer accepts the offer electronically, the entrepreneur will confirm the receipt of the acceptance electronically. As long as this confirmation has not been received, the consumer can dissolve the agreement.
Article 6 - Right of Withdrawal
When purchasing products, the consumer has the possibility to cancel the agreement within 14 days without stating reasons. This cooling-off period starts the day after the consumer receives the product or a representative previously designated by the consumer.
Article 7 - Costs in the Event of Withdrawal
If the consumer exercises the right of withdrawal, the costs of returning the products are at the consumer's expense. If the consumer has paid an amount, the entrepreneur will reimburse this amount as soon as possible, but no later than 14 days after withdrawal, provided the product has already been received by the entrepreneur or sufficient proof of return delivery has been provided.
Article 8 - Exclusion of the Right of Withdrawal
The entrepreneur may exclude the consumer's right of withdrawal for certain products and services, provided this is clearly stated in the offer before the agreement is concluded.
Article 9 - Price
During the validity period of the offer, the prices of the offered products and/or services will not be increased, unless due to changes in VAT rates.
Article 10 - Conformity and Warranty
The entrepreneur guarantees that the products and/or services comply with the agreement and the specifications as stated in the offer.
Article 11 - Delivery and Execution
The entrepreneur will take the greatest care when receiving and executing orders for products. The place of delivery is the address provided by the consumer.
Article 12 - Continuous Transactions: Duration, Cancellation, and Extension
The consumer can cancel a continuous agreement for a specified or indefinite period of time at any time, subject to the agreed cancellation rules and a notice period of no more than one month.
Article 13 - Payment
Unless otherwise agreed, the amounts owed by the consumer must be paid within 7 working days after the cooling-off period begins, as defined in Article 6, Paragraph 1.
Article 14 - Complaints Procedure
Complaints about the execution of the agreement must be submitted fully and clearly within 7 days after the consumer has detected the defects.
Article 15 - Disputes
Dutch law applies to agreements between the entrepreneur and the consumer, to which these general terms and conditions apply, even if the consumer resides abroad.
